Mailin is a software service designed to assist businesses in generating and managing professional email accounts specifically for sending business-to-business emails. Introduction

Welcome to Mailin ("Company," "we," "our," "us"). These Terms of Service ("Terms") govern your use of our web pages operated by Mailin. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages. Please find and review the Privacy Policy on our website.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). By using our Service, you acknowledge that you have read and understood the Agreements and agree to be bound by them. If you do not agree with (or cannot comply with) the Agreements, you may not use the Service. Please let us know by contacting our support team so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use the Service.

Communications

By creating an Account on our Service, you agree to subscribe to newsletters, marketing, or promotional materials, and other information we may send. However, you may opt out of receiving any or all of these communications from us by following the instructions provided in those communications.

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase, including without limitation your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete. We may employ the use of third-party services, such as Stripe and PayPal, to facilitate payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties, subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons. We may also refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Mailin cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Mailin customer support via our support channels.

A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide Mailin with accurate and complete billing information, including full name, address, state, zip code, telephone number, and a valid payment method. By submitting such payment information, you automatically authorize Mailin to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Mailin will issue an electronic invoice indicating that you must proceed manually within a certain deadline date with the full payment corresponding to the billing period as indicated on the invoice.

Fee Changes

Mailin, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Mailin will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds and Disputes

All payments made to Mailin are final and non-refundable under any circumstances, except where required by applicable law.

This includes, without limitation, subscription fees, setup/onboarding fees, warmup costs, server or domain expenses, and any other charges related to the use of Mailin’s services.

Why payments are final. Mailin provides immediate digital infrastructure provisioning upon payment— including server deployment, IP allocation, DNS configuration, monitoring, and deliverability setup. These processes create instant, non-recoverable costs and constitute service activation and delivery. Accordingly, no refunds, credits, chargebacks, or pro-rated adjustments will be issued once activation has begun.

No-refund examples (non-exhaustive). Refunds are not issued due to:

  • Early cancellation or termination (voluntary or for policy violations)
  • Dissatisfaction with performance or deliverability results
  • Failure to use or access the Service after activation
  • Service interruptions, maintenance, or temporary unavailability
  • Third-party platform behavior outside Mailin’s control
  • Billing/usage errors caused by inaccurate or incomplete information provided by you

Disputes. If you believe a billing error occurred, contact Mailin Support first so we can investigate and resolve quickly. You retain the right to contact your payment provider; however, by completing your purchase you acknowledge you accepted these Terms (including the non-refundability of payments) and that service activation and provisioning occurred. Mailin may provide documentation and system logs to the processor confirming (1) your acceptance of these Terms prior to payment and (2) activation/provisioning details (e.g., server creation, IP assignment, DNS setup timestamps). Account access may be suspended during an unresolved payment dispute.

21-Day Deliverability Guarantee (sole limited exception). A refund may be considered only if all conditions below are met and verified:

  • You escalated a deliverability concern to Mailin Support within the first 21 days of service.
  • You completed a full 21-day warmup period with no cold outreach or marketing sends.
  • You granted Mailin access to verify sending activity and deliverability data (e.g., sequencer access, logs)
  • You followed Mailin’s deliverability recommendations throughout that period; and
  • Mailin confirmed results below reasonable industry expectations for the warmup phase

If any condition is not met, the request is automatically denied. Mailin retains sole discretion to determine compliance with applicable law for any legally required refund.

Governing Law. This policy is governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.

Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service for:

  • Spamming: You are prohibited from sending emails that violate the CAN-SPAM Act.
  • Phishing: You are prohibited from sending fraudulent emails that attempt to steal information.
  • Malicious Content: You are prohibited from distributing any content that contains malware, viruses, or other harmful code.
  • Harassment: You are prohibited from using our email service to harass, intimidate, or threaten any individual or group.
  • Illegal Activities: You are prohibited from using our email service to engage in any illegal activities.
  • Prohibited Industries: You are prohibited from using our service for certain industries, including but not limited to crypto, political activities, or any industry not compliant with the Anti-Spam Act.
Additionally, you agree not to:
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party’s use of the Service, including their ability to engage in real-time activities through the Service.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack

If you become aware of any violations, please report them to us immediately by contacting our support team.

Anti-Spam and Appropriate Usage Policy

Mailin is committed to ethical and compliant email marketing practices. Users are expected to adhere to legal standards, including the CAN-SPAM Act, and to follow best practices for email outreach.

  • Prohibited Sending Purposes: Users may not use Mailin’s services for phishing, illegal activities, sending low-quality or malicious content, harassment, or any activity that could impair our service.
  • Prohibited Sending Content: The following content is not allowed: illegal goods or services, pornography, gambling, multi-level marketing, get-rich-quick schemes, and any content violating CAN-SPAM, GDPR, or other local laws.
  • Appropriate Mailing Lists: Users must ensure their mailing lists include a valid postal address, an easy opt-out method, and that messages provide value to recipients.

Analytics

We may use third-party service providers to monitor and analyze the use of our Service. These providers may include tools such as:

  • Google Analytics: Used to track and report website traffic.
  • Fathom Analytics: A privacy-focused analytics platform.
  • Tracking Pixels: Such as those from Twitter, Meta (Facebook), and others for marketing and analytics purposes.

Accounts

When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Service Usage

Permitted Use: Users must follow best practices for email sending to maintain a good reputation. This includes avoiding spam, excessive links, and other behaviors that could harm deliverability.

Restrictions: Users are prohibited from using Mailin for non-business purposes, sending spam, or engaging in any activity that could harm the service or other users.

Violation Handling: Any violations of these guidelines may result in account suspension or termination.

Pricing and Payments

Mailin offers subscription plans as described on our pricing page.

All fees are billed in advance on a recurring basis according to your selected plan.

All payments are final and non-refundable once service activation begins, except where required by applicable law.

Because Mailin’s services involve immediate infrastructure provisioning (including server deployment, IP allocation, and monitoring), refunds, credits, or pro-rated adjustments are not available after activation.

You are responsible for maintaining valid payment information. Should automatic billing fail, Mailin may issue an electronic invoice requiring manual payment by the due date listed.

Failure to complete payment may result in service suspension or termination.

Fee changes will take effect at the end of your current billing cycle. Continued use of the Service after a fee change constitutes acceptance of the new rate.

Limitation of Liability

Mailin's liability is limited to the amount paid by the user for the service.
